The question the US government asked itself repeatedly for thirteen years and answered differently each time: whether taking soldiers and civilians through psychoenergetic training and operations constituted experimentation on human subjects under 45 CFR Part 46 and Procedure 18 of DoD Directive 5240.1-R. The Army General Counsel said yes in February 1979; the Surgeon General's board said no in March 1979 and yes in November 1979; DoD General Counsel approved a finding in November 1981 that it was human experimentation whose benefits justified the risks; and the CIA in December 1992 decided to treat Operation Stargate 'as if' it did.
